Pakistan Cyberspace Awareness (PECA 2016)
The Prevention of Electronic Crimes Act (PECA), 2016 is the primary legislation governing cybercrime in Pakistan. This section serves to educate the citizens of Pakistan on their digital rights, responsibilities, and where to seek help in case of cyber incidents.
Digital Rights & Safe Practices
- ✓Freedom of Expression: You have the right to express opinions legally under Article 19, provided it does not constitute hate speech or defame individuals.
- ✓Report Cyber Harassment: You have the legal right to report non-consensual sharing of intimate images, blackmail, and online stalking to the NCCIA (National Cyber Crime Investigation Agency).
- ✓Data Privacy: You should actively use 2FA and encryption. Unauthorized access to your devices by anyone (including telecom operators without a warrant) is illegal.
Punishable Offenses under PECA
- ✗Unauthorized Access (Hacking): Accessing any information system or data without authorization carries strict fines and imprisonment (Section 3).
- ✗Hate Speech & Glorification of Offenses: Spreading religious, ethnic, or sectarian hatred online is strictly prohibited (Section 11).
- ✗Electronic Forgery & Fraud: Identity theft, spoofing, and financial scams via electronic means carry heavy penalties (Sections 13 & 14).
- ✗Cyber Stalking: Repeatedly harassing or intimidating someone online, or taking their pictures without consent, is a criminal offense (Section 24).
Where & How to Seek Help
National Cyber Crime Investigation Agency (NCCIA)
An independent, dedicated agency established to exclusively handle cybercrimes, financial frauds, and online harassment in Pakistan. (It has taken over cybercrime jurisdiction from the FIA).
Pakistan Telecommunication Authority (PTA)
For reporting illegal, blasphemous, or defamatory content hosted on public websites.
